The short version. HIT ME is a practice tool. Nothing in it involves real money, the practice coins are worth nothing, and getting good at the app is no guarantee of winning at a casino. Subscriptions renew automatically until you cancel them in your App Store settings.
1. Agreeing to these terms
These terms are an agreement between you and Quiet Edge Labs LLC ("we", "us"), the publisher of the HIT ME app. By downloading or using the app you agree to them. If you do not agree, please do not use the app.
The app is also licensed to you under Apple's standard Licensed Application End User License Agreement (EULA). Where these terms say something more specific about HIT ME, these terms apply.
2. Who can use the app
HIT ME is intended for adults. You must be at least 18 years old, or the age of majority where you live if that is higher, to use it.
3. What the app is, and what it is not
HIT ME teaches and drills card counting for blackjack. It is provided for education and entertainment only.
- No real money. The app does not offer gambling. You cannot wager, win or lose real money in it.
- Practice coins have no value. The coins used at the Table cannot be bought, sold, transferred, cashed out or exchanged for anything. We may reset or change coin balances at any time.
- No guarantee of results. Skill in the app does not guarantee any result at a real table. Casino gambling carries a real risk of losing money, and you are solely responsible for any decision to gamble.
- Not advice. Nothing in the app is financial, legal or professional advice.
4. Card counting and casinos
Counting cards in your head is generally lawful, but casinos are private businesses and many of them refuse service to, or remove, players they believe are counting. Rules and laws differ from place to place. You are responsible for knowing and following the laws where you are and the rules of any venue you visit. Using a phone or any other device to help you count at a casino table is illegal in many places, and the app must not be used that way.
5. If gambling stops being fun
If you or someone you know is struggling with gambling, free and confidential help is available in the United States from the National Problem Gambling Helpline. Call or text 1-800-MY-RESET (1-800-697-3738), or chat at 1800myreset.org. Outside the United States, please look for a support service in your country.
6. Free and paid features
The counting drills are free. The Table, where you practise counting during live hands, requires a HIT ME Pro subscription.
7. Subscriptions
- Plans. HIT ME Pro is offered as a monthly plan and a yearly plan. The yearly plan may begin with a free trial. The price and length of each plan, and of any trial, are shown in the app before you buy.
- Payment. Payment is charged to your Apple Account when you confirm the purchase. If you start a free trial, you are charged when the trial ends unless you cancel at least 24 hours before then.
- Automatic renewal. Your subscription renews automatically for the same period and at the same price unless you cancel at least 24 hours before the end of the current period.
- Cancelling. You can manage or cancel your subscription at any time in your App Store account settings. Cancelling stops future renewals. You keep access until the end of the period you have already paid for.
- Refunds. Purchases are processed by Apple, and refunds are handled by Apple under its own policies. We cannot issue refunds ourselves.
- Price changes. Prices can differ by country and may change. If the price of your plan changes, Apple will tell you beforehand and, where required, ask you to agree.
- Restoring. If you reinstall the app or change phones, tap "Restore purchases" to bring back an active subscription.
8. Your practice data
Your practice history is stored on your phone and, if you choose, in your own iCloud. We do not keep a copy and cannot recover it for you if it is lost, for example if you delete the app without backing up. See the Privacy Policy for details.
9. Acceptable use
You may use the app for your own personal, non-commercial practice. You may not copy, modify, resell or reverse engineer the app, or use it in any way that breaks the law.
10. Ownership and credits
The app, including its design, text and code, belongs to us or to those who have licensed material to us. The playing card faces are based on Vectorized Playing Cards by Chris Aguilar, used under the GNU Lesser General Public License (LGPL), version 3.0. That artwork remains available under the same license from its author.
11. No warranty
The app is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent the law allows. We do not promise that the app will always be available, free of errors or suited to a particular purpose.
12. Limit of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental or consequential loss arising from your use of the app, including any gambling losses, loss of data or loss of profits. Our total liability to you for any claim relating to the app is limited to the amount you paid for it in the twelve months before the claim arose. Some places do not allow these limits, so parts of this section may not apply to you.
13. Changes
We may update the app and these terms from time to time. When we change the terms we will update this page and the date at the top. If you keep using the app after a change, you accept the updated terms.
14. Governing law
These terms are governed by the laws of the State of California, United States, without regard to its rules on conflicts of law. This does not take away any consumer protection you are entitled to under the law of the place where you live.
